Stichting HappiApp's Terms of Use and Privacy
1. Management
1.1 The application HappiApp (the “App”) is managed by the foundation Stichting HappiApp. You can contact this foundation on info@happiapp.nl.
1.2 Stichting HappiApp is the "controller" as defined in the General Data Processing Regulation (EU) 2016/679 ("GDPR"). E-sites B.V. is the "processor" as defined in the GDPR.
1.3 You have been informed in advance about the processing of your personal data through the HappiApp, and you have given your express permission for this.
1.4 Stichting HappiApp and the treating hospital give you a non-exclusive right to use the App for non-commercial purposes. This means that you are not allowed to make the App available to third parties or sell, rent out, decompile, reverse engineer or modify it without the prior permission of Stichting HappiApp. You are not allowed either to remove or bypass, or have others remove or bypass, any technical features intended to protect the App.
1.5 All provisions on updates, support and liability contained in these Terms of Use apply to the App by analogy.
2. Data and personal data of users
2.1 Your data will only be stored on the phone on which the App is installed.
2.2 In processing any required personal data, Stichting HappiApp, the OLVG hospital en E-sites B.V. will adhere to the provisions of the GDPR.
3. Use of the App
3.1 Your use of the App is at your own risk and expense.
3.2 To use the App, you must provide, at your own expense, for any appropriate equipment and any necessary software yourself.
3.3 You are responsible for the use of the App yourself. Stichting HappiApp does not provide support on this, except when it decides to correct some error reported by the user.
3.4 The App may only be used on the device on which it was downloaded and installed.
4. Security
Stichting HappiApp will do everything possible to provide the App and personal data with the best security, while meeting the requirements of the GDPR.
5. Updates
5.1 Stichting HappiApp may, from time to time, issue updates to fix any errors or improve the performance of the App.
5.2 Available updates to the App will be notified through Apple's Appstore and Google's Playstore, and it is the user's responsibility to keep track of such notifications.
6. Limitation of liability
Stichting HappiApp makes every effort to ensure that the information in the App is accurate, but cannot guarantee that the information in the App is complete or accurate at all times and is therefore not liable for this.
7. Other provisions
7.1 These Terms of Use and Privacy are governed by the laws of the Netherlands.
7.2 Any disputes between Stichting HappiApp and the user shall be referred to the competent court in Utrecht, the Netherlands.
7.3 If any provision of these Terms of Use and Privacy is void or voidable, the remaining provisions of the Terms of Use and Privacy shall continue in force and effect. Stichting HappiApp and the user shall consult on the content of any new provision(s) to replace the void or voidable provision(s). With that, the starting point shall be that the new content is to correspond as much as possible to the purport and purpose of the original provision(s).
7.4 In addition to these Terms of Use and Privacy, Apple's Appstore and Google's Playstore may impose terms and conditions on obtaining the App, using it, and any related matters. For this purpose, the user should refer to the terms of use and the privacy statement of Apple's Appstore, Google's Playstore and any applicable terms and conditions on the respective provider's website.
7.5 These Terms of Use and Privacy may be changed from time to time. If these Terms of Use and Privacy are changed, we will communicate this in the App (under PRIVACY). There, you will also be able to read the new provisions. Make sure you visit this section of the App regularly so that you will be aware of any changes.
7.6 In addition to these Terms of Use and Privacy, the terms and conditions of the OLVG hospital and of E-sites B.V. also apply to the App, insofar as they are relevant to the use of the App. Those terms and conditions can be found on the respective websites of these two entities.
